End User License Agreement (EULA)

1. License Grant

Breathr grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, strictly in accordance with this Agreement and Apple app store rules.

2. License Restrictions

You may not:

• Copy, distribute, or modify the App or any part of it.
• Reverse-engineer, decompile, or attempt to extract the source code.
• Rent, lease, sell, sublicense, or commercially exploit the App.
• Remove or obscure trademarks, copyright notices, or proprietary rights.
• Use the App for any unlawful, abusive, or fraudulent purpose.

3. Ownership

All intellectual property rights in the App, including software, design, branding, logos, text, and graphics, are owned by Breathr or its licensors. This Agreement grants you a license to use the App; it does not transfer ownership.

4. Privacy & Data

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you consent to data handling as outlined in the Privacy Policy.

5. Subscription & Payments

Some features of the App may be available through auto-renewable subscriptions.

• Payments are processed securely by Apple (App Store).
• Breathr does not process or store payment details.
• Subscriptions renew automatically unless canceled through your App Store or Play Store account settings.
• No refunds are provided for unused portions of a subscription term, except as required by law.

6. Service Availability

We strive to keep the App available, but we do not guarantee uninterrupted or error-free operation. The App may be suspended temporarily for maintenance, updates, or technical issues.

7. Health Disclaimer

Breathr is a wellness and motivational tool designed to support users in reducing or quitting vaping. It does not provide medical advice, diagnosis, or treatment. Always seek the guidance of a qualified healthcare professional for medical concerns.

8. Termination

This license is effective until terminated by you or Breathr. We may suspend or terminate your license immediately if you fail to comply with this Agreement. Upon termination, you must uninstall and stop using the App.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or uninterrupted operation.

10. Limitation of Liability

To the maximum extent permitted by law:

• Breathr and its affiliates are not liable for indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities.
• Our total liability to you for any claim arising from this Agreement or the App will not exceed the amount you paid for the subscription in the 12 months preceding the claim.

11. Business Transfers & Legal Compliance

If Breathr is involved in a merger, acquisition, or sale of assets, this Agreement and your license may transfer to the new entity under the same protections.

We may also disclose information if required by law, regulation, or legal process.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
